ںaggravating حالات mitigating V/S حالات میں فرق۔

 اaggravating حالات وہ حالات ہیں جن پر عدالت کسی فوجداری مقدمے میں زیادہ سخت سزا دینے کے لیے غور کر سکتی ہے، ایک فوجداری مقدمے میں استغاثہ بڑھنے والے عوامل کے ثبوت پیش کر سکتا ہے جو مقدمے کی سماعت کے دوران سخت سزا کے قابل ہوں گے۔

 بڑھنے والے عوامل مندرجہ ذیل ہو سکتے ہیں،

 1) اسی طرح کے جرائم کا پچھلا ریکارڈ۔

 2) خطرناک ہتھیار کا استعمال یا شکار کو لگنے والی چوٹوں کی شدت۔

 3) عادی مجرم۔

 4) اگر شکار ایک عورت، پاگل شخص یا چھوٹا بچہ ہے۔

 5) مجرم کا اہم کردار۔

 6) ریاست کے خلاف غداری کے جرائم۔

 عام 𝐌𝐢𝐭𝐢𝐠𝐚𝐭𝐢𝐧𝐠 𝐜𝐢𝐫𝐜𝐮𝐦𝐬𝐭𝐚𝐧𝐜𝐞𝐬 میں یہ عوامل شامل ہیں:

 1) سابقہ ​​مجرمانہ ریکارڈ کی کمی۔

 2) جرم میں معمولی کردار۔

 3) متاثرہ کا قصور اور اکسانا،

 4) ذہنی یا جسمانی بیماری۔

 5) اچانک اشتعال انگیزی اور افسردگی کی کیفیت۔ 

Aggravating circumstances are those circumstances which may be considered by the court to pass a more severe punishment in a criminal case, In a criminal case Prosecution can offer evidence of aggravating factors that would merit a harsh sentence during trial.

Aggravating factors may be following,

1) Previous record of similar offences. 

2) Use of a dangerous weapon or the severity of the injuries inflicted upon a victim .

3) Habitual offender.

4) if victim is a woman, insane person or a young child.

5) Major role of offender.

6) Offences of treason against state,.

Mitigating Circumstances:-

Mitigating circumstances are those factors which may be taken into consideration by the Court to make the punishment less severe.

Common mitigating factors include:

1) Lack of a prior criminal record.

2)Minor role in the offense.

3)culpability and instigation of the victim,

4) Mental or physical illness.

5) Sudden provocation and state of depression.
